The Federal Trade Commission is causing a stink over mobile phones that were lost in the wake of the TDI scandal. The government agency is suggesting that the phones, which may have contained evidence relevant to the case against Volkswagen, were intentionally destroyed by the automaker.
“In the context of the massive scandal at the center of this case, 23 lost or bricked phones is a bright red flag, especially when they include phones that belonged to important individuals,” said FTC attorneys in a court filing.
The FTC is now asking Judge Breyer to order further questioning against a designated corporate witness. Volkswagen, for its part, contends that the witness, Manuel Sanchez, has already answered thousands of questions.
Despite that, the FTC says Sanchez “was either unprepared or otherwise unable to provide responsive information.”
If, indeed, any evidence is missing, it would be bad news for VW and could result in increased fines.
